DMCA Policy

Avira Nutrition respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA) of 1998, the text of which may be found on the U.S. Copyright Office website at https://www.copyright.gov/legislation/dmca.pdf, Avira Nutrition will respond expeditiously to claims of copyright infringement committed using the Avira Nutrition service and/or the Avira Nutrition website (the "Site") if such claims are reported to Avira Nutrition's Designated Copyright Agent as identified in the sample notice below.

Filing a DMCA Notice of Infringement

If you are a copyright owner, or are authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the Avira Nutrition Site by completing the following DMCA Notice of Alleged Infringement and delivering it to Avira Nutrition's Designated Copyright Agent.

Upon receipt of a Notice as described below, Avira Nutrition will take whatever action, in its sole discretion, it deems appropriate, including removal of the challenged content from the Site.

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages.

  1. Identification of the copyrighted work: Identify the copyrighted work that you claim has been infringed, or if multiple copyrighted works are covered by this Notice, you may provide a representative list of the copyrighted works that you claim have been infringed.
  2. Identification of the infringing material: Identify the material that you claim is infringing (or to be the subject of infringing activity) and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit Avira Nutrition to locate the material (e.g., the URL(s) of the material on the Avira Nutrition Site).
  3. Contact information of the complaining party: Provide your mailing address, telephone number, and, if available, email address.
  4. Statement of good faith belief: Include a statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. Statement of accuracy and perjury clause: Include a statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  6. Electronic or Physical Signature: Provide your electronic or physical signature (typing your full legal name is sufficient for an electronic signature).

Counter-Notification to a DMCA Notice of Infringement

If you believe that your content that was removed (or to which access was disabled) is not infringing, or that you have the authorization from the copyright owner, the copyright owner's agent, or pursuant to the law, to post and use the material in your content, you may send a counter-notification containing the following information to Avira Nutrition's Designated Copyright Agent:

  • Identification of the removed material: Identify the content that has been removed or to which access has been disabled and the location at which the content appeared before it was removed or disabled (e.g., the specific URL(s)).
  • Sworn statement of good faith belief: A statement under penalty of perjury that you have a good faith belief that the content was removed or disabled as a result of mistake or a misidentification of the content.
  • Subscriber's contact information: Your name, address, telephone number, and, if available, email address.
  • Consent to jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Avira Nutrition may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
  • Electronic or Physical Signature: Your electronic or physical signature (typing your full legal name is sufficient for an electronic signature).
